Stella Awards

It's time again for the annual 'Stella Awards'!
For those unfamiliar with these awards, they are named
after 81-year-old Stella Liebeck who spilled hot coffee on
herself and successfully sued the McDonald's in New
Mexico , where she purchased coffee. You remember, she
took the lid off the coffee and put it between her knees
while she was driving. Who would ever think one could
get burned doing that, right? That' s right; these
are awards for the most outlandish lawsuits and verdicts in
the U.S. You know, the kinds of cases that make you
scratch your head. So keep your head scratcher
handy.

To those whom may be wondering about the facts concerning the McDonalds incident:

Pkin38 was correct in the state being New Mexico. The incident happened in 1992, and the following link outlines some of legal details of the case evidently from the 'defense' viewpoint.

However, I personally take a veiwpoint that people should take responsibility for their own mistakes and not pass the blame to others.

I don't know about the courts in the US, but here in Canada judges have no say in what goes to court; they handle what's put into their courtrooms and make their decisions only on what they hear from people under oath and what the law tells them they must do. Therefore, the lawyers involved are the ones who got the matter into court because the plaintiff and the insurers for the companies involved were not able to settle the matter themselves.
So far as the "Stella" matter is concerned, the "facts" seem to have shifted over time. One of the lawyers involved says that the matter happened in California and the reward to the elderly woman was McDonalds' profit for one day in that state. The coffee was being held between her legs, (not too bright, I agree) but what happened was that she was holding it a little too firmly and the lid "volcanoed," causing third degree burns to her whole crotch area. The coffee had also been heated too much, in an effort to keep it hot longer. Since the case, the coffee in takeout cups is no longer heated as much and the design of the cups is such that they will no longer allow them to "volcano" all over people.

Only in America--The good ol' U.S.A. And again the honest people pay the price for the stupidity of the mother AND the jury, not to mention that the judge should have never allowed it to go to trial.

The store owners should have countersued for not controlling her child so that a customer was injured. Do I feel some more of these coming on, Pat? Should be interesting and scary.

Good morning Pat, woke up to rain ,have over 1.50" of rain so far. and it will not stop until noon. oh well. these stupid people and we have to put up with it with higher premiums.

This is a great view Pat, as for the Stella awards this was the start of our insurance premiums rising, foolish lawsuits are good for no one!
