Ah, so it is. See: http://www.allaboutbirds.org/guide/Black-headed_Grosbeak/id The beak was not right for the Baltimore Oriole, it was definitely "gros." I have never seen these but perhaps because they are more common in the western part of North America.
Thanks guys. It isn't an Oriole, or at least not a Scott's Oriole. We have those and I think I've got them figured out. Now I'll google black headed grosbeak....
The coloration is like an oriole (Baltimore oriole - see: http://www.allaboutbirds.org/guide/baltimore_oriole/id ), but the beak on this bird doesn't seem to be as sharp and pointed. Perhaps it is just the way the bird is sitting and the angle of the picture.
